The Spanish Notary: a public official but not a liberal professional

The objective of a Notary is that the contract, business or declaration is adjusted to legality and is unassailable. The public deed is reliable before the courts of Justice: nobody doubts its veracity.

It is important to emphasise that the role of the Notary in Spain will not be the same as the Notary in other countries such as France, therefore a foreign client accustomed to receiving a notarial advice in another country should always think that in Spain there are differences in the Legal obligations incumbent on Notaries simply because it is not the same country.

Let us first assume that the worst transaction, even written by an ignorant notary, is better than the best trial. (Honoré de Balzac)
